Delhi HC Offers Interim Relief to L-G Over Injunction on AAP's 'Defamatory Allegations'

New Delhi: The Delhi high court on Tuesday, September 27, restrained the Aam Aadmi Party and five of its leaders from levelling allegations against Lieutenant Governor Vinai Kumar Saxena and his family, offering relief to the latter who had sought an injuction against what he claimed were ‘defamatory’ statements.

AAP leaders had alleged that Saxena was involved in a scam during his tenure as the Khadi and Village Industries Commission (KVIC) chairman in 2016.

Addressing a press conference, AAP national spokesperson and Rajya Sabha MP Sanjay Singh had demanded that legal proceedings be initiated against Saxena for allegedly awarding the contract to his daughter in violation of the law.

“LG V.K. Saxena, during his term as KVIC chairman, misused his position and awarded a contract for interior designing of a Khadi lounge in Mumbai to his daughter. In awarding the contract, he violated the provisions of the KVIC Act 1961,” Singh had charged.

Justice Amit Bansal, while pronouncing the ad interim injunction order, said, “I have passed an ad-interim injunction order in favour of the plaintiff and a take down order. There are detailed directions.”

The detailed order is awaited.

Besides, Saxena has also sought to stop AAP, its leaders Atishi Singh, Saurabh Bharadwaj, Durgesh Pathak, Sanjay Singh and Jasmine Shah, who was appointed by the Government of NCT of Delhi as Vice Chairperson of the Dialogue and Development Commission, to delete or take down the alleged false and libellous posts or tweets or videos circulated and issued on social media.

He has also sought damages and compensation of Rs 2.5 crore along with interest from the political party and its five leaders.

LiveLaw has reported that while issuing summons on Saxena’s suit, the court on September 22 said written statements be filed within thirty days and also sought affidavit of admission or denial from the defendants. The suit was accompanied with an application for interim relief filed under Order 31 Rule 1 and 2 of Code of Civil Procedure praying for a temporary injunction to restrain the party and its members, until the disposal of the suit or until further orders.
