Das highlights how the court has diluted some of the harsh provisions of the Prevention of Money Laundering Act and Unlawful Activities (Prevention) Act, raising questions about the government’s ability to keep these leaders incarcerated.

He also examines the critical role played by the bench of Justice B.R. Gavai, which has criticised the selective actions of government agencies like the Enforcement Directorate and reiterated the legal principle that “bail is the rule, jail is the exception”.
