Do Indian citizens have the freedom to think and speak without fear? Can they raise the voice of dissent and openly express their views? Ultimately it all depends on the credibility of the judiciary, who are the defenders of these rights. So today we ask, do our judges have integrity and do our judges have a spine?

In an interview with Karan Thapar for The Wire, one of the most illustrious former judges of the Supreme Court of India, Justice Deepak Gupta explains this. He also recently raised in an article for The Tribune newspaper.

Justice Gupta also argues that the collegium system has “failed”, that it has become “totally opaque”. He believes “almost all, if not all” recently appointed judges are upper caste. The “majority are Brahmins”. He says “the Supreme Court, if it has to be the Supreme Court of the country, must have representation from all sections of society”. If not trust and faith in the judiciary will wane which, he believes, has already started. He says “if people lose faith in the judiciary, the judiciary itself becomes irrelevant”.
